Disney tries dismissing wrongful death lawsuit with Disney+ trial

The Walt Disney Co. was recently sued by Jeffrey Piccolo. The reason is because a restaurant located in Disney World resulted in the death of Jeffrey’s wife, Kanokporn Tangsuan, who was allergic to nuts and dairy.

The husband and wife explicitly told the waiter at the restaurant that she was allergic, and the waiter assured them that the meal they ordered would be allergy-free. However, that was not the case.

The wife unfortunately died because the meal contained ingredients that Jeffrey’s wife was allergic to. As a result, Jeffrey sued Disney, and took them to court. He is only asking for a small amount in order to cover medical and funeral expenses.

In a shocking turn of events, Disney is attempting to toss out this lawsuit, stating that Jeffrey agreed to their Terms of Service, all the way in 2019, from a one-month Disney+ Free Trial Subscription. In the Terms of Service, it states that all disputes with Disney must be handled outside of court.

Disney is receiving a lot of backlash online due to this decision, and time will tell what the judge in the case will decide.
